Junk Removal Service Agreement
1. General Terms
By requesting services from JUNKRUSH® ("PROVIDER"), the Customer agrees to the following terms and conditions. These terms are binding upon acceptance of services.
Note: By agreeing to these terms online, through a checkbox, electronic signature, or similar acknowledgment, the Customer agrees that this constitutes a legally binding agreement between the Customer and JUNKRUSH®, equivalent to a signed paper contract.
2. Pricing & Payments
2.1 Pricing Structure
Pricing is based on volume, weight, or time (time applies only to the self-service option, whichever is greater), as well as any overages incurred.
Weight Limitations:

A full load includes up to 4,000 lbs. Additional weight will be charged at:

Self-Service: $0.13 per pound for weight exceeding 4,000 lbs.

Full-Service: $0.20 per pound for weight exceeding 4,000 lbs.

All loads must remain under 8,000 lbs. For operational safety, loads exceeding this limit are strongly discouraged.
Load Rejection:
If a load exceeds 8,000 lbs or is deemed unsafe by the driver due to improper loading, hazardous materials, or other safety concerns, the driver reserves the right to reject the load at their discretion." Customers are advised to review Section 5.4 Rejection of Materials for additional details about unsafe materials and rejected loads.
Example for Clarity:
If a load weighs 4,500 lbs:

The first 4,000 lbs are included in the base rate.

The extra weight (500 lbs exceeding 4,000 lbs) is charged at $0.13/lb for self-service or $0.20/lb for full-service.
2.2 Landfill Fees

Customer is responsible for any additional landfill fees incurred due to unauthorized waste materials. If landfill fees are assessed after service completion, the Customer must pay the balance upon notification. Failure to pay within the designated time frame may result in additional penalties.
2.3 Self-Service Time Limits

The on-site driver will wait for up to 2 hours. A $1.25 per minute fee applies for time exceeding the 2-hour limit.
2.4 Payment Terms

Payment is required after each individual load is completed. For example, if the service results in three separate loads, the Customer will be charged and must pay for each load as it is completed, resulting in three separate charges.

Under specific circumstances, JUNKRUSH® may require a deposit before the commencement of service. If a deposit is required, it must be paid before loading begins, regardless of whether the Customer selects the full-service or self-service option.

All payments must be made in full immediately upon completion of each load. If the Customer fails to pay the balance on the day of notification, they will have up to 15 days to settle the Overdue Balance. A 5% penalty fee will be applied to any outstanding balance due to non-payment the same day for services rendered.

In cases where additional fees (e.g., overweight charges, unauthorized waste fees, or other service-related adjustments) were not initially calculated or expected at the time of service completion, the Customer will be notified immediately via phone, email, text message, or any other communication method chosen by the Customer or assigned by JUNKRUSH®. Once notified, the Customer is expected to provide payment on the same day.

JUNKRUSH® accepts credit card payments only, unless prior arrangements for cash, check, or other digital payment options are made. Returned checks will incur associated bank fees.

The Customer authorizes JUNKRUSH® to store and charge the provided credit card for any resulting charges or fees.
2.5 Pricing Modifications

From time to time, prices may change or be updated due to market conditions, location, disposal facility rate increases, or other factors that affect operational costs. For this reason, it is the responsibility of the Customer to confirm the current service rates prior to scheduling. Customers should consult with JUNKRUSH® directly or visit the JUNKRUSH® website to verify the most up-to-date pricing information.
3. Full-Service Clauses
3.1 Loading Responsibility

JUNKRUSH® staff will load materials into the truck.
3.2 Labor Overages

If excessive labor is required beyond the agreed scope of work (e.g., dismantling a considerably oversized item, demolishing a building structure, or moving an excessive amount of items that are not part of the removal service and would significantly extend the scope of work), additional fees will apply. These fees must be properly estimated by one of our team members in advance. Upon request, a separate proposal will be provided detailing the scope of the proposed work.
3.3 Convenience Fee for Condominiums and Apartments

A convenience fee may apply for services in condominiums or apartment buildings where elevators or stairs are required to remove items. This fee is not applicable in all cases but must be discussed during the appointment to provide an accurate quotation.
3.4 Damage Waiver

JUNKRUSH® is not liable for damages to property caused by the removal of large or difficult-to-access items unless due to gross negligence.
4. Self-Service Clauses
4.1 Container Usage

Customer agrees to load the container in compliance with the Container Use terms (see Section 5).

Customer is responsible for ensuring that loaded materials are balanced and do not exceed the container’s capacity or weight limit.
4.2 Time-Based Pricing
-
Pricing for self-service includes the time the driver is on-site. If the loading time exceeds the included 2-hour limit, additional charges of $1.25 per minute will apply.
4.3 Equipment Damage

Customer is liable for damages to the truck or equipment beyond reasonable wear and tear.
4.4 Driver Time
-
Drivers will remain on-site for up to 2 hours. Additional waiting time will incur charges as outlined in Section 4.2.
5. Container Use
5.1 Prohibited Materials
Customers may not place the following items into containers:

Hazardous, toxic, or corrosive materials.

Liquid substances of any kind.
-
Medical waste or animal remains.
-
Petroleum-based products or any other materials deemed unsafe by local regulations.
5.2 Weight and Balance

Materials must remain within the container's sides, and weight should be evenly distributed.
5.3 Risk Acknowledgment

Customer releases JUNKRUSH® from liability for injuries or damages caused during the use of the container, equipment, or tools.
5.4 Rejection of Materials

JUNKRUSH® reserves the right to refuse unsafe or prohibited materials. Any required unloading will be at the Customer’s expense.
6. Access and Ground Conditions
6.1 Site Access

Customer must provide clear and safe access for the truck. This includes removing obstructions and ensuring suitable ground conditions for placement.
6.2 Damage to Surfaces

JUNKRUSH® is not liable for damage to surfaces such as driveways, paving, or soft ground caused by the weight of the truck or container. Customers are responsible for protecting surfaces prior to service.
6.3 Post-Service Retrieval

JUNKRUSH® reserves the right to enter the premises without notice to retrieve the truck or container after the service period ends.
7. Cancellations and Rescheduling
7.1 Cancellation Policy
Cancellations made less than 24 hours prior to the scheduled service may incur a $75 fee, which applies only to back-to-back cancellations. A back-to-back cancellation is defined as a consecutive cancellation of a previously rescheduled or canceled appointment.
JUNKRUSH® reserves the right to refuse or discontinue providing services if repeated cancellations create scheduling conflicts, operational inefficiencies, or indicate a pattern of misuse of our services.
7.2 Rescheduling
Customers may reschedule services at no additional cost if notice is given at least 24 hours in advance.
8. Indemnification
Customer agrees to indemnify and hold JUNKRUSH® harmless from all claims, liabilities, damages, or injuries arising out of or related to the Customer’s use of the container, equipment, or services, except in cases of JUNKRUSH®'s gross negligence or willful misconduct.
9. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.
By requesting services, the Customer acknowledges that they have read, understood, and agreed to these terms.
